Terms of Service

These terms govern your use of Fork’s website, software, workspaces, and related services.

1. About these terms

Fork is a service of Pickaxe Inc. (“Fork,” “we,” “us,” or “our”). By accessing or using Fork, you agree to these Terms of Service (“Terms”). If you use Fork for an organization, you represent that you have authority to agree on its behalf. If you do not agree, do not use the service.

A separate signed agreement, order form, or statement of work may add to or change these Terms for a particular customer. If there is a conflict, that agreement controls for the services it covers.

2. The service

Fork provides tools to create, host, operate, and use software and AI powered workflows. Features, availability, integrations, and beta offerings may change. We may maintain, update, suspend, or discontinue parts of the service. Any particular deliverable, service level, support commitment, or access period exists only if stated in an applicable written agreement.

Subject to these Terms and any applicable agreement, we grant you a limited, nonexclusive, nontransferable right to use the service during your authorized access period. Fork and its licensors retain their rights in the underlying platform, software, branding, and reusable components.

3. Accounts and workspaces

You must provide accurate account information, protect your credentials, and promptly tell us if you suspect unauthorized access. You are responsible for activity under your account and for managing the people you invite to your workspaces. Do not share access in ways that bypass permissions or billing rules.

Workspace owners and administrators may be able to access, manage, export, or remove content and activity within their workspaces. If you use a workspace provided by another organization, that organization may set additional rules for your access.

4. Your content and applications

You retain the rights you have in data, files, prompts, code, and other material that you or your users submit to Fork (“Customer Content”). You grant us the limited rights needed to host, process, display, transmit, secure, support, and operate the service for you, including through service providers and integrations you enable. You are responsible for having the rights and permissions needed to submit and use Customer Content.

If you build or operate an application or workspace for other people, you are responsible for its content, access settings, notices, consents, and compliance with applicable law. You must make clear to your end users when you and your authorized team can access their information. Your own terms or privacy notice may also apply to those users.

Project specific deliverables, source code, and transfer rights are governed by the applicable written agreement. These Terms alone do not transfer ownership of the Fork platform or reusable components.

5. AI services and output

Fork may use third party AI models and other providers to process inputs and generate output. Their services may have separate terms or restrictions. AI output can be inaccurate, incomplete, or similar to output produced for others. You are responsible for reviewing output before relying on it, publishing it, or using it in decisions that affect people.

As between you and Fork, we do not claim ownership of your Customer Content or of output generated for you, except for rights needed to provide the service and any rights in Fork’s underlying technology. Rights in AI output may also depend on applicable law and provider terms.

6. Acceptable use

You may not use Fork to break the law, infringe another person’s rights, distribute malware, interfere with security or service operation, gain unauthorized access, misrepresent the origin of content, or send unlawful spam. Do not use the service to process information you are not permitted to use. We may investigate and restrict activity that threatens users, the service, or third parties.

7. Third party services

Fork may connect to external websites, data sources, payment providers, AI models, and other services. Your use of them may be governed by their own terms, fees, and privacy practices. You are responsible for the connections and permissions you authorize. We are not responsible for changes or outages in third party services outside our control.

8. Fees and payment

Fees, billing periods, included usage, overage charges, and any refund or cancellation rights are set out at checkout or in an applicable written agreement. You authorize the charges you approve. Unless an agreement says otherwise, fees already paid are nonrefundable except where required by law. We will not charge you for a separately priced third party service without your authorization.

9. Security and privacy

We use reasonable technical and organizational measures to protect the service and Customer Content. No online service can be guaranteed completely secure. You are responsible for appropriate account controls, permissions, backups or exports where available, and for promptly reporting suspected misuse. Our handling of personal information is described in our Privacy Policy. A separate data processing agreement may apply where agreed in writing.

10. Intellectual property notices

Fork’s names, logos, and other brand features are owned by Pickaxe Inc. or its licensors. You may not use them in a way that suggests endorsement without permission. If you believe content on Fork infringes your copyright, send a notice with the work, the material and its location, your contact information, and a statement of your good faith belief to hello@fork.site.

11. Beta features and changes

Some features are experimental and may be changed or withdrawn. They are provided for evaluation unless a written agreement says otherwise. We may update these Terms by posting a revised version and, when appropriate, providing additional notice. The updated Terms apply from the stated effective date. Material changes to an existing paid engagement are governed by its written agreement.

12. Suspension and termination

You may stop using Fork at any time, subject to any payment or notice obligations in your agreement. We may suspend access to address security risks, unlawful use, nonpayment, or a material breach of these Terms. We may terminate access if the issue is not resolved or if required by law. Any rights to export data or receive deliverables after termination are governed by your agreement and applicable law.

13. Disclaimers and liability

Except for express commitments in a written agreement and to the extent permitted by law, the service is provided “as is” and “as available,” without implied warranties. We do not guarantee uninterrupted access or a particular result from AI output or third party integrations. Nothing in these Terms excludes rights or liability that cannot lawfully be excluded.
